Fandations allows approved users, creators, educators, mentors, professionals and community builders to build profiles, publish content, offer subscriptions, sell or unlock digital materials, communicate with users, and earn money from eligible content and services.

These Terms and Conditions, together with any policies referenced in them, govern your access to and use of Fandations.

By visiting Fandations.com, creating an account, browsing content, subscribing to a creator, purchasing digital content, uploading content, sending messages, becoming a creator, receiving payments, or using any part of the platform, you agree to these Terms.

If you do not agree to these Terms, you must not access or use Fandations.

These Terms apply to all users of Fandations, including:

1. visitors;

2. registered users;

3. members;

4. subscribers;

5. creators;

6. educators;

7. mentors;

8. purchasers;

By using Fandations, you agree to follow all policies that apply to your use of the platform.

3. About Fandations

Fandations is designed to help people share knowledge, build audiences, support creators, access learning materials, and participate in creator-led communities.

Fandations may allow users to:

1. create an account;

2. follow creators;

3. subscribe to creators;

4. purchase or unlock digital content;

5. access posts, videos, images, downloads, templates, messages, livestreams or communities;

6. send messages;

7. comment or interact with content;

8. support creators;

9. become creators;

10. receive payments, where eligible.

Available features may change over time.

Fandations may add, remove, suspend, restrict, modify or discontinue features at any time.

4. Fandations Is Not an Adult-Content Platform

Fandations is not an adult-content platform.

You must not use Fandations to upload, publish, sell, promote, request, arrange, distribute, message, livestream or monetise:

1. pornography;

2. sexually explicit content;

3. escort services;

4. sexual services;

5. sexual solicitation;

6. paid sexual messaging;

7. fetish content;

8. nudity intended for sexual gratification;

9. adult-only content;

10. links to adult-content platforms.

Any such content may be removed, and accounts involved may be restricted, suspended, terminated, reported or subject to payout holds.

5. Age Requirement

Fandations is for users aged 18 or over.

By accessing or using Fandations, you confirm that:

1. you are at least 18 years old;

2. you have legal capacity to agree to these Terms;

3. you are not prohibited from using the platform under applicable law;

4. all information you provide is accurate and truthful.

We do not knowingly allow children to create accounts.

If we believe a user is under 18, we may suspend or delete the account, restrict access, remove content, cancel subscriptions, withhold payouts where appropriate, and request verification.

6. Account Registration

You may need to create an account to access certain features.

When creating an account, you agree to:

1. provide accurate information;

2. keep your information up to date;

3. use your real identity where required for verification, payments, safety or legal compliance;

4. keep your login details secure;

5. not share your account with another person;

6. not create accounts using false, misleading or stolen information;

7. not create multiple accounts to evade restrictions, bans, payment rules or moderation.

You are responsible for all activity that occurs under your account.

You must tell us promptly if you believe your account has been accessed without permission.

7. Account Security

You are responsible for maintaining the confidentiality of your login credentials.

You must not:

1. share passwords;

2. sell or transfer your account;

3. allow another person to use your account;

4. use another person’s account;

5. attempt to access accounts, systems or data without permission;

6. bypass security measures.

We may suspend, restrict or disable accounts where we believe there is unauthorised access, fraud, security risk, misuse, breach of these Terms or unlawful activity.

8. User Verification

We may require users or creators to complete verification checks.

Verification may be required for:

1. age confirmation;

2. identity confirmation;

3. creator approval;

4. payout eligibility;

5. tax reporting;

6. fraud prevention;

7. account recovery;

8. safety investigations;

9. compliance checks;

10. legal or regulatory obligations.

We may request information including:

1. legal name;

2. date of birth;

3. address;

4. government-issued identification;

5. tax information;

6. payout details;

7. business information;

8. proof of rights or permissions;

9. other information reasonably required.

If you do not provide requested information, or if we cannot verify the information provided, we may restrict, suspend or terminate your account or withhold payouts where permitted by law.

HMRC guidance confirms that UK digital platform operators may have obligations to collect and report seller information, including information connected to sellers and income earned through digital platforms. (GOV.UK)

9. Acceptable Use

You may use Fandations only for lawful purposes and in accordance with these Terms.

You must not use Fandations to:

1. break the law;

2. infringe another person’s rights;

3. upload prohibited content;

4. harass, abuse, threaten or intimidate others;

5. impersonate another person or organisation;

6. mislead users;

7. operate scams or fraud;

8. distribute malware;

9. scrape, copy or harvest platform data without permission;

10. interfere with the platform;

11. bypass payment systems;

12. manipulate engagement or reviews;

13. create fake accounts;

14. evade bans or restrictions;

15. misuse reporting, refund, payout or support systems.

A breach of these Terms may result in content removal, account restriction, suspension, termination, payout holds, reporting to authorities, or other action.

10. User-Generated Content

Fandations may allow users to upload, publish, send, stream, display, sell or share content.

This may include:

1. text;

2. images;

3. videos;

4. audio;

5. livestreams;

6. comments;

7. messages;

8. downloads;

9. templates;

10. files;

11. profile information;

12. community posts;

13. creator content;

14. educational materials;

15. links.

This is referred to as User Content.

You are solely responsible for your User Content.

You must ensure that your User Content:

1. is lawful;

2. is accurate where presented as factual;

3. does not infringe anyone’s rights;

4. does not contain prohibited material;

5. does not mislead users;

6. complies with these Terms and our policies;

7. is suitable for Fandations.

Fandations does not endorse, verify or guarantee User Content.

11. Your Content Ownership

You retain ownership of content that you upload or publish on Fandations, subject to the licence you grant to us.

You are responsible for ensuring that you have all necessary rights, licences, permissions and consents to upload, publish, sell, stream, display, distribute or make your content available through Fandations.

You must not upload content that is copied, stolen, leaked, pirated, scraped, unauthorised, confidential, defamatory, unlawful or infringing.

12. Licence You Grant to Fandations

By uploading, posting, submitting, publishing, messaging, livestreaming, selling or otherwise making content available on Fandations, you grant Fandations a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to:

1. host;

2. store;

3. copy;

4. reproduce;

5. process;

6. scan;

7. review;

8. moderate;

9. display;

10. publish;

11. stream;

12. transmit;

13. distribute;

14. adapt for technical purposes;

15. resize;

16. compress;

17. encode;

18. transcode;

19. create thumbnails or previews;

20. make available to users;

21. promote within the platform;

22. use for safety, security, legal, moderation and support purposes.

This licence is granted only for the purpose of operating, providing, improving, securing, promoting and enforcing Fandations.

This licence continues for as long as necessary to provide the platform, honour user purchases or subscriptions, comply with legal duties, resolve disputes, process refunds or chargebacks, maintain backups, investigate abuse, enforce policies, or meet tax, accounting, audit or regulatory requirements.

13. Content Removal

You may be able to remove your own content using available platform tools.

However, removal may not immediately delete all copies of the content.

Content may continue to exist:

1. in backups;

2. in moderation records;

3. in transaction records;

4. in legal or safety records;

5. where users have already purchased, downloaded, unlocked or accessed it;

6. where retention is required for tax, accounting, payment, legal, fraud prevention or dispute purposes.

We may remove or restrict content at any time where we believe it breaches these Terms, our policies, applicable law, payment processor rules, safety standards or platform requirements.

14. Prohibited Content

You must not upload, publish, sell, stream, message, promote, link to or otherwise make available content that includes, encourages, facilitates or offers:

1. pornography or sexually explicit material;

2. adult sexual services;

3. escorting or sexual solicitation;

4. nudity intended for sexual gratification;

5. child sexual abuse material or child exploitation;

6. content involving minors in sexual, exploitative or abusive contexts;

7. non-consensual intimate imagery;

8. deepfake intimate imagery;

9. harassment, bullying, stalking or threats;

10. hate speech or hateful conduct;

11. terrorism, extremism or violent radicalisation;

12. violence, threats or incitement;

13. doxxing or privacy violations;

14. illegal goods or services;

15. illegal drugs or weapons;

16. fraud, scams or phishing;

17. malware, hacking or credential theft;

18. pyramid schemes or misleading income schemes;

19. money laundering or suspicious financial activity;

20. unauthorised financial promotions;

21. regulated financial advice without authorisation;

22. unsafe medical or health claims;

23. copyright infringement;

24. counterfeit goods;

25. academic cheating services;

26. stolen personal data;

27. anything unlawful or unsuitable for Fandations.

This list is not exhaustive.

15. Online Safety

Fandations aims to provide a safer environment for users and creators.

We may use reporting tools, moderation systems, automated checks, manual review, user blocking, account restrictions, policy enforcement, audit logs and safety processes to reduce misuse.

Users can report content, profiles, messages, comments or behaviour that may breach our policies or applicable law.

Depending on the issue, we may:

1. take no action;

2. warn a user;

3. restrict content;

4. remove content;

5. disable features;

6. suspend an account;

7. terminate an account;

8. hold payouts;

9. preserve records;

10. report matters to payment providers, regulators, law enforcement or relevant authorities.

The UK Online Safety Act imposes duties on in-scope services relating to illegal content, risk assessments and protective measures, and Ofcom has published guidance for services on illegal content risk assessments and protections. (GOV.UK)

16. Community Rules

You agree to follow our Community Guidelines.

You must not:

1. harass, abuse or threaten others;

2. use hate speech;

3. impersonate others;

4. share private information without permission;

5. spam users;

6. manipulate engagement;

7. post scams;

8. pressure users into payments;

9. promote illegal or unsafe behaviour;

10. misuse reporting tools;

11. interfere with another user’s enjoyment of the platform.

We may take action against behaviour that harms users, creators, Fandations, or the integrity of the platform.

17. Creators

Creators are users who publish content, build communities, receive support, sell access, offer subscriptions, or otherwise monetise content on Fandations.

Creators must agree to the Fandations Creator Agreement.

Creators are independent users of the platform. They are not employees, workers, agents, partners, franchisees or representatives of Fandations.

Creators are responsible for:

1. their content;

2. their profile;

3. their statements;

4. their offers;

5. their pricing;

6. their tax affairs;

7. their qualifications;

8. their legal compliance;

9. their rights and permissions;

10. their conduct toward users.

Fandations does not guarantee that any creator will earn money, gain subscribers, build an audience, receive engagement or achieve any particular result.

18. Creator Monetisation

Fandations may allow eligible creators to monetise content through features such as:

1. subscriptions;

2. paid posts;

3. paid downloads;

4. paid communities;

5. one-off unlocks;

6. tips or support payments;

7. paid messages;

8. livestream access;

9. bundles;

10. other creator tools.

Available monetisation features may change.

Creators must ensure that all paid offers are accurate, lawful and not misleading.

Creators must not sell access to prohibited content, unlawful services, misleading claims, regulated advice without authorisation, or anything that breaches these Terms.

19. Payments

Payments on Fandations may be processed by third-party payment providers.

By making a payment, you agree to provide accurate payment information and authorise the relevant payment.

You must not use stolen, unauthorised, fraudulent or invalid payment methods.

We may refuse, cancel, reverse, investigate or restrict transactions where we believe there is fraud, abuse, chargeback risk, policy breach, legal concern, payment processor issue or security risk.

Sensitive payment card information may be handled by payment processors rather than stored directly by Fandations.

20. Subscriptions

Fandations may allow users to subscribe to creators, communities or other paid features.

Subscription terms, pricing, billing frequency and benefits should be shown before purchase.

Unless stated otherwise:

1. subscriptions renew automatically until cancelled;

2. cancellation stops future renewal;

3. access may continue until the end of the paid period;

4. partial refunds are not guaranteed;

5. failed payments may result in loss of access;

6. creators may change available content or benefits;

7. Fandations may change subscription features over time.

You are responsible for cancelling subscriptions before renewal if you do not want to continue.

21. Digital Content and Access

Fandations may provide access to digital content, including posts, files, videos, downloads, templates, livestreams, messages, communities or other materials.

When you purchase or unlock digital content, you are buying access under the terms shown at checkout. You are not buying ownership of the content unless expressly stated.

You must not:

1. copy;

2. resell;

3. redistribute;

4. leak;

5. publish;

6. share;

7. scrape;

8. screen-record;

9. upload elsewhere;

10. commercially exploit digital content without permission.

Creators retain rights in their content unless otherwise stated.

22. Refunds

Refunds are governed by our Refund Policy and applicable law.

Because Fandations may provide digital content, access may begin immediately after purchase.

Refund availability may depend on:

1. whether content has been accessed;

2. whether content has been downloaded;

3. whether a subscription period has started;

4. whether there has been fraud or misuse;

5. whether there was a technical error;

6. whether the payment was unauthorised;

7. whether applicable law requires a refund.

Tips, support payments and donations-style payments may be non-refundable unless required by law or approved by Fandations.

Chargeback abuse may result in account restriction or termination.

23. Creator Payouts

Creator payouts are subject to the Creator Agreement and Payments and Payouts Policy.

Payouts may depend on:

1. identity verification;

2. age verification;

3. tax information;

4. payment processor approval;

5. minimum payout thresholds;

6. refund windows;

7. chargeback risk;

8. fraud checks;

9. compliance checks;

10. sanctions screening;

11. account standing.

Fandations may delay, withhold, offset, reverse or refuse payouts where we reasonably believe funds are connected to fraud, chargebacks, refunds, suspicious activity, illegal content, policy breaches, tax obligations, identity issues, sanctions concerns, platform misuse or legal obligations.

24. Taxes

Users and creators are responsible for their own taxes.

Creators are responsible for determining, reporting and paying all taxes arising from their creator activity, income, subscriptions, sales, tips, support payments or other earnings.

Fandations does not provide tax advice.

We may collect, verify, retain and report tax-related information where required by law.

Digital platform reporting rules may require platform operators to collect and report seller and income information to HMRC, with platform reports generally due by 31 January for the previous year. (GOV.UK)

25. Finance, Business and Investment Content

Fandations may allow general educational content about business, money management, budgeting, entrepreneurship, finance, trading or investing.

However, Fandations does not provide financial advice, investment advice, tax advice, legal advice, pension advice, insurance advice, credit advice or regulated financial services.

Creators must not provide regulated financial advice, investment recommendations, financial promotions, trading signals, crypto promotions, credit offers, debt advice, pension advice, insurance advice or tax advice unless legally authorised to do so and approved by Fandations.

Finance content must be educational, balanced, clear, fair and not misleading.

Users should not make financial decisions based solely on content found on Fandations.

The FCA’s social media financial promotions guidance states that financial promotion rules are technology-neutral and apply across social media channels, and the FCA has recently continued action against illegal “finfluencer” promotions. (FCA)

26. Health, Fitness and Wellbeing Content

Fandations may include general educational content about health, fitness, nutrition, lifestyle or wellbeing.

Such content is for general information only and is not medical advice.

Users should consult a qualified healthcare professional before acting on health, fitness, nutrition, mental wellbeing or medical-related content.

Creators must not provide diagnosis, treatment, emergency advice or regulated healthcare services unless legally authorised and approved by Fandations.

27. Educational Content Disclaimer

Fandations does not guarantee that any content, course, creator, post, guide, livestream, message, template, download or community will produce any specific result.

We do not guarantee:

1. income;

2. profit;

3. business success;

4. investment returns;

5. grades;

6. qualifications;

7. skills;

8. employment;

9. health outcomes;

10. legal outcomes;

11. personal outcomes;

12. audience growth;

13. creator earnings.

Users are responsible for how they use information obtained through Fandations.

28. Intellectual Property

Fandations and its platform, branding, software, design, layout, logos, trademarks, graphics, text, features, databases, systems and technology are owned by or licensed to Fandations.

You must not copy, reproduce, modify, distribute, sell, lease, reverse engineer, scrape or exploit any part of Fandations without permission, except as permitted by law or by platform functionality.

Fandations™ and the Fandations logo are trademarks of Fandations Ltd.

You must not use Fandations’ name, logo, branding or trademarks without written permission.

29. Copyright Complaints

Fandations respects intellectual property rights.

If you believe content on Fandations infringes your copyright or other rights, you may contact us at:

Your notice should include:

1. your name and contact details;

2. identification of the copyrighted work or protected material;

3. identification of the content complained about;

4. the URL or location of the content;

5. a statement explaining why you believe the use is unauthorised;

6. a statement that the information you provide is accurate;

7. confirmation that you are the rights owner or authorised to act for the rights owner.

We may remove or restrict content in response to valid complaints.

We may suspend or terminate repeat infringers.

30. Third-Party Services

Fandations may use or link to third-party services, including:

1. payment processors;

2. hosting providers;

3. analytics providers;

4. email providers;

5. identity verification providers;

6. tax reporting providers;

7. customer support tools;

8. embedded media;

9. external websites;

10. creator links.

Third-party services are not controlled by Fandations.

Your use of third-party services may be subject to their own terms, privacy policies and fees.

Fandations is not responsible for third-party websites, services, content, policies, failures, outages, acts or omissions.

31. Cookies and Tracking

Fandations may use cookies and similar technologies for functionality, security, analytics, preferences, payments, fraud prevention and marketing, where permitted by law.

Non-essential cookies, analytics tools, marketing pixels and similar technologies will be used where required consent has been obtained, unless an exemption applies.

32. Privacy

We process personal data in accordance with our Privacy Policy.

By using Fandations, you acknowledge that we may collect and process personal data for purposes including:

1. account creation;

2. platform access;

3. identity verification;

4. age verification;

5. payments;

6. payouts;

7. tax reporting;

8. fraud prevention;

9. safety;

10. moderation;

11. customer support;

12. analytics;

13. security;

14. legal compliance.

You must not use Fandations to collect, misuse, sell, publish or exploit another person’s personal data unlawfully.

33. Platform Availability

We aim to keep Fandations available, but we do not guarantee uninterrupted access.

The platform may be unavailable, interrupted or limited due to:

1. maintenance;

2. updates;

3. technical issues;

4. outages;

5. third-party failures;

6. cyber incidents;

7. legal requirements;

8. safety or security measures;

9. payment processor issues;

10. circumstances beyond our control.

We may modify, suspend or discontinue all or part of Fandations at any time.

34. Beta Features and Changes

Some features may be experimental, beta, trial or limited-release features.

Such features may be changed, withdrawn, restricted or discontinued at any time.

We may update the platform, change layouts, add or remove features, modify monetisation options, update fees, change creator tools, or revise eligibility requirements.

35. Moderation and Enforcement

Fandations may monitor, review, scan, restrict, remove, demonetise, disable or block content, accounts, payments, messages, links, profiles, comments, communities or features.

We may take action where we believe there is:

1. a breach of these Terms;

2. a breach of our policies;

3. unlawful activity;

4. safety risk;

5. fraud risk;

6. payment risk;

7. tax or reporting risk;

8. sanctions risk;

9. intellectual property infringement;

10. user harm;

11. reputational risk;

12. misuse of the platform.

We are not required to pre-screen all content, and failure to act in one case does not prevent us from acting in another.

36. Account Suspension and Termination

We may suspend, restrict, disable or terminate your account at any time if we believe:

1. you breached these Terms;

2. you breached our policies;

3. you broke the law;

4. you provided false information;

5. you are under 18;

6. you failed verification;

7. your account poses a security risk;

8. you engaged in fraud, abuse or misconduct;

9. you infringed third-party rights;

10. you used prohibited content;

11. you bypassed payment systems;

12. you created risk for users, creators, Fandations or third parties;

13. we are required to do so by law, regulator, court order, payment processor or authority.

You may stop using Fandations at any time.

Some obligations continue after account closure, including payment obligations, tax obligations, intellectual property obligations, licences, disclaimers, liability limits, indemnities and legal compliance obligations.

37. Account Deletion

You may request account deletion where available.

Deleting your account may not immediately delete all information.

We may retain information where necessary for:

1. legal compliance;

2. tax reporting;

3. accounting;

4. fraud prevention;

5. chargebacks;

6. refunds;

7. disputes;

8. safety investigations;

9. moderation records;

10. law enforcement requests;

11. backups;

12. legitimate business purposes.

38. Complaints and Appeals

Where available, you may appeal certain decisions, including content removal, account suspension, creator restriction or payout hold.

Appeals do not guarantee reversal of a decision.

39. Law Enforcement and Legal Requests

We may preserve, disclose or share information where we believe it is reasonably necessary to:

1. comply with law;

2. respond to legal process;

3. protect users;

4. protect Fandations;

5. prevent fraud;

6. investigate illegal activity;

7. enforce these Terms;

8. respond to emergencies;

9. cooperate with regulators, courts, payment processors, tax authorities or law enforcement.

We may notify users of legal requests where permitted, but we are not required to do so where prohibited or where notification may create risk.

40. Disclaimers

Fandations is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we do not guarantee that:

1. the platform will be uninterrupted;

2. the platform will be error-free;

3. the platform will be secure at all times;

4. content will be accurate or reliable;

5. creators will provide any particular result;

6. users will enjoy or benefit from content;

7. creators will earn money;

8. users will be satisfied with purchases;

9. content will remain available;

10. third-party services will function properly.

Fandations does not endorse all User Content and is not responsible for the opinions, claims, advice, offers or conduct of users or creators.

41. Limitation of Liability

Nothing in these Terms limits or excludes liability where it would be unlawful to do so.

To the maximum extent permitted by law, Fandations will not be liable for:

1. loss of profits;

2. loss of revenue;

3. loss of business;

4. loss of goodwill;

5. loss of opportunity;

6. loss of data;

7. indirect loss;

8. consequential loss;

9. user-generated content;

10. creator conduct;

11. third-party services;

12. payment processor issues;

13. unauthorised access caused by your failure to secure your account;

14. content removed under these Terms;

15. account suspension or termination resulting from breach or risk.

Where liability cannot be excluded, our total liability to you will be limited to the greater of:

1. the amount you paid to Fandations in platform fees during the six months before the issue arose; or

2. £100.

This limit does not apply where the law does not allow such limitation.

42. Indemnity

You agree to indemnify and hold harmless Fandations, its directors, officers, employees, contractors, agents, service providers and affiliates from and against any claims, losses, liabilities, damages, costs, expenses, legal fees or demands arising from or connected with:

1. your use of Fandations;

2. your User Content;

3. your creator content;

4. your breach of these Terms;

5. your breach of our policies;

6. your breach of law;

7. your infringement of third-party rights;

8. your fraud, abuse or misconduct;

9. your tax obligations;

10. your dealings with other users;

11. your unauthorised professional, financial, legal, tax, health or regulated advice.

43. Consumer Rights

Nothing in these Terms affects your statutory rights that cannot be excluded or limited under applicable law.

If you are a consumer, you may have legal rights relating to digital content, services, subscriptions, cancellation, refunds and faulty services.

Where these Terms conflict with mandatory consumer rights, your mandatory rights will apply.

44. Force Majeure

4. payment processor outages;

5. labour disputes;

6. natural disasters;

7. war;

8. terrorism;

9. pandemics;

10. government action;

11. legal restrictions;

12. power failures;

13. third-party service failures.

45. Changes to These Terms

We may update these Terms from time to time.

Where changes are material, we may notify you by email, platform notice, account notice or other reasonable method.

Your continued use of Fandations after updated Terms take effect means you accept the updated Terms.

If you do not agree to updated Terms, you must stop using Fandations.

46. Assignment

You may not assign, transfer or delegate your rights or obligations under these Terms without our written permission.

Fandations may assign or transfer its rights and obligations under these Terms as part of a merger, acquisition, restructuring, sale of assets, change of control or transfer of business operations.

47. Severability

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from or relating to these Terms, except where applicable consumer or mandatory law gives you rights to bring claims elsewhere.
