Creator Agreement

This Creator Agreement applies to creators who use Fandations to create, upload, publish, sell, share, promote, livestream, message, provide access to, or receive payment for content, services, communities, subscriptions or digital materials through the Fandations platform.

Fandations’ slogan is:

By applying to become a creator, creating a creator account, uploading content, publishing content, accepting payments, receiving payouts, using creator tools, or otherwise using Fandations as a creator, you agree to this Creator Agreement.

This Agreement should be read together with our Terms of Service, Privacy Policy, Cookie Policy, Community Guidelines, Acceptable Use Policy, Prohibited Content Policy, Payments and Payouts Policy, Refund Policy, Online Safety Policy, Finance Content Rules, and any other policies or terms published by Fandations.

1. About Fandations

Fandations is a creator-support and knowledge-sharing platform that allows creators, educators, mentors, professionals and other approved users to build communities, share digital content, offer subscriptions, publish educational materials, communicate with supporters, and earn money from eligible content or services.

Fandations is designed for educational, creative, practical, business, professional and community-based content.

Fandations is not an adult-content platform.

Sexually explicit content, pornography, escort services, sexual services, sexual solicitation, adult-only material, or content primarily intended for sexual gratification is not permitted.

2. Creator Eligibility

To become or remain a creator on Fandations, you must:

1. be at least 18 years old;

2. have legal capacity to enter into this Agreement;

3. provide accurate registration information;

4. provide accurate identity, tax, payment and payout information where required;

5. comply with this Agreement and all Fandations policies;

6. comply with all applicable laws and regulations;

7. not be located in, resident in, or acting on behalf of a person or entity subject to applicable sanctions or platform restrictions;

8. not have previously been banned, suspended or removed from Fandations unless we have given written permission for you to return.

We may refuse, suspend or remove creator access at our discretion where we believe there is a legal, safety, fraud, payment, tax, compliance, reputational or platform-risk concern.

3. Creator Status

Creators are independent users of the platform.

You are not an employee, worker, agent, representative, partner, joint venturer or franchisee of Fandations.

Nothing in this Agreement creates an employment relationship, agency relationship, partnership or joint venture between you and Fandations.

You are solely responsible for:

1. your content;

2. your profile;

3. your statements;

4. your offers;

5. your pricing;

6. your tax affairs;

7. your qualifications;

8. your licences and permissions;

9. your legal compliance;

10. your dealings with members, subscribers, followers or purchasers.

4. Creator Verification

We may require you to complete identity, age, address, tax, payout, fraud-prevention, sanctions, business or compliance checks before you can:

1. become a creator;

2. publish paid content;

3. receive payments;

4. withdraw funds;

5. access certain platform features;

6. recover an account;

7. continue using Fandations where a risk concern arises.

You agree to provide complete, accurate and up-to-date information when requested.

We may request documents or information including, but not limited to:

1. government-issued identification;

2. proof of age;

3. proof of address;

4. tax identification information;

5. bank or payout account details;

6. business information;

7. evidence of professional authorisation;

8. evidence that you have rights to publish particular content;

9. consent records for persons depicted in content;

10. additional information required by our payment processors, verification providers, regulators, tax authorities or legal obligations.

If you fail verification, refuse to provide requested information, provide false information, or we cannot reasonably verify your identity, age, rights, tax information or payout eligibility, we may restrict, suspend or terminate your creator account and withhold payouts where permitted by law.

HMRC guidance confirms that reporting platform operators may need to collect and verify seller information and may limit seller access if sellers refuse to provide required information. (GOV.UK)

5. Creator Account Security

You are responsible for keeping your account secure.

You must:

1. use accurate account information;

2. keep your login credentials confidential;

3. not share your account with others;

4. notify us promptly if you suspect unauthorised access;

5. not allow another person to operate your creator account without our permission;

6. not use another person’s account or identity.

We may suspend or restrict your account if we believe it has been compromised or misused.

6. Content Ownership

You retain ownership of content that you upload, publish or submit to Fandations, subject to the licence you grant to us under this Agreement.

You are responsible for ensuring that you own or have all necessary rights, permissions, licences and consents to upload, publish, sell, display, stream, distribute or otherwise make your content available through Fandations.

You must not upload, publish, sell or distribute content that infringes another person’s copyright, trademark, privacy rights, publicity rights, image rights, confidentiality rights, contractual rights or other legal rights.

7. Licence to Fandations

By uploading, publishing, submitting, messaging, streaming, selling or otherwise making content available on Fandations, you grant Fandations a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to:

1. host;

2. store;

3. copy;

4. process;

5. scan;

6. moderate;

7. review;

8. display;

9. perform;

10. transmit;

11. stream;

12. distribute;

13. reproduce;

14. resize;

15. compress;

16. encode;

17. transcode;

18. adapt for technical purposes;

19. make available to users;

20. promote within the platform;

21. use for platform previews, thumbnails, recommendations and search;

22. use for safety, security, compliance, reporting and support purposes.

This licence exists only for the purpose of operating, providing, securing, improving, promoting and enforcing Fandations and its services.

This licence continues for as long as your content remains on Fandations or as long as necessary for legal, safety, backup, audit, dispute, tax, payment, reporting or compliance purposes.

If your content has been purchased, unlocked, downloaded, accessed, streamed, subscribed to, licensed or otherwise obtained by users before removal, those users may continue to have access where permitted by the applicable purchase terms, subscription terms or platform functionality.

8. Content Review and Moderation

Fandations may review, pre-screen, moderate, restrict, label, demonetise, remove or refuse content before or after publication.

We may use a combination of automated systems, manual review, user reports, trusted flaggers, payment processor requirements, legal notices and internal safety processes.

We may take action if we believe content:

1. breaches this Agreement;

2. breaches our Community Guidelines;

3. breaches our Acceptable Use Policy;

4. breaches our Prohibited Content Policy;

5. breaches our Finance Content Rules;

6. may be illegal;

7. may create harm or safety risk;

8. may expose Fandations to legal, regulatory, payment, tax, fraud, reputational or operational risk;

9. may infringe third-party rights;

10. may mislead users;

11. may be unsuitable for the platform.

Moderation decisions may include:

1. no action;

2. warning;

3. content edit request;

4. content label;

5. content restriction;

6. content removal;

7. reduced visibility;

8. demonetisation;

9. feature restriction;

10. account suspension;

11. account termination;

12. payout hold;

13. referral to payment processors, regulators, law enforcement or relevant authorities where appropriate.

Ofcom states that in-scope services under the UK Online Safety Act must assess illegal content risks and put protections in place. (www.ofcom.org.uk)

9. Prohibited Creator Content

You must not upload, publish, sell, stream, message, promote or link to content that includes, encourages, facilitates or offers:

1. pornography or sexually explicit material;

2. adult sexual services;

3. escorting, sexual solicitation or prostitution;

4. nudity intended for sexual gratification;

5. child sexual abuse material or child exploitation;

6. content involving minors in sexual, exploitative, abusive or inappropriate contexts;

7. non-consensual intimate imagery;

8. deepfake intimate imagery;

9. sexualised images of real people without consent;

10. harassment, bullying, stalking or intimidation;

11. hate speech or hateful conduct;

12. terrorism, extremism or violent radicalisation;

13. threats, incitement or glorification of violence;

14. doxxing or sharing private personal information;

15. illegal drugs, weapons or regulated goods;

16. fraud, scams, phishing or deception;

17. pyramid schemes or misleading earning schemes;

18. money laundering or suspicious financial activity;

19. malware, credential theft, hacking or platform abuse;

20. copyright-infringing or pirated material;

21. stolen, leaked, scraped or unauthorised content;

22. fake qualifications or misleading professional claims;

23. academic cheating services;

24. medical diagnosis or treatment claims without appropriate authorisation;

25. regulated financial advice or unauthorised financial promotions;

26. gambling services where not legally authorised;

27. counterfeit goods;

28. any content that is illegal or prohibited by Fandations policies.

This list is not exhaustive.

10. No Adult Content

Fandations is not an adult-content platform.

Creators must not use Fandations to publish, sell, promote, request, arrange, distribute or monetise adult sexual content or sexual services.

This includes, but is not limited to:

1. pornography;

2. explicit sexual videos or images;

3. sexual livestreams;

4. sexual messaging services;

5. paid sexual chat;

6. sexual roleplay services;

7. escorting;

8. fetish content;

9. nudity intended for sexual gratification;

10. links to adult-content platforms;

11. promotion of off-platform adult services.

We may remove content, suspend creator access, withhold payouts, terminate accounts, or report unlawful material where appropriate.

11. Consent and Documentation

You must obtain and retain all required rights, permissions and consents for content you upload or publish.

If any person appears, is identifiable, is heard, is named, is depicted, contributes to, performs in, or is otherwise included in your content, you must obtain and keep written consent from that person where required by law or by Fandations.

Consent should clearly cover:

1. the person’s participation in the content;

2. the person’s agreement to be recorded, photographed, filmed or depicted;

3. the person’s agreement to publication on Fandations;

4. the person’s agreement to commercial use, where applicable;

5. the person’s agreement to distribution, streaming, downloading or user access, where applicable;

6. the person’s agreement to continued access by users who previously purchased or unlocked content, where applicable.

You must verify that all persons depicted in your content are at least 18 years old.

You must not upload content depicting a person if you do not have the necessary rights, permissions or consent.

We may request proof of consent, identity, age or rights at any time. You agree to provide such documentation promptly.

Failure to provide requested documentation may result in content removal, account restriction, payout hold, suspension or termination.

12. Image, Voice and Likeness Consent

By creating a creator account, uploading profile images, publishing creator content, appearing in content, or using Fandations as a creator, you grant Fandations permission to use your name, username, profile image, public biography, image, voice, likeness, brand assets and creator content previews for the purpose of operating, displaying, promoting and improving the platform.

This may include use in:

1. creator profiles;

2. search results;

3. recommendations;

4. category pages;

5. previews;

6. subscription pages;

7. platform emails;

8. social media previews;

9. promotional materials;

10. internal safety, support and compliance systems.

We will not sell your image or likeness as a standalone asset.

13. Creator Responsibilities

As a creator, you agree that you will:

1. provide accurate information;

2. keep your profile truthful and up to date;

3. publish only content you have the right to publish;

4. comply with all Fandations policies;

5. comply with applicable law;

6. respond honestly to verification and compliance requests;

7. avoid misleading claims;

8. avoid unlawful, harmful or exploitative content;

9. treat users respectfully;

10. not manipulate reviews, engagement, subscriptions or payments;

11. not abuse reports, refunds, chargebacks or support systems;

12. not evade fees;

13. not encourage users to bypass Fandations payment systems;

14. not misrepresent your qualifications, experience, identity or results;

15. not use Fandations for illegal activity.

You are responsible for backing up your own content. Fandations is not a storage or backup service.

14. Creator Standards

Creators must act professionally and responsibly.

You must not:

1. make false claims about your skills, earnings, qualifications or experience;

2. guarantee results;

3. pressure users into purchases;

4. exploit vulnerable users;

5. mislead users about pricing, access or outcomes;

6. impersonate another person or organisation;

7. use fake testimonials;

8. hide sponsorships or affiliate arrangements;

9. manipulate scarcity, urgency or fear in a misleading way;

10. sell content or services that you cannot reasonably provide;

11. use abusive, discriminatory, threatening or coercive behaviour.

15. Educational Content

Creators may publish educational, practical, business, creative or professional content, provided it complies with this Agreement and all applicable policies.

You acknowledge that Fandations does not guarantee that users will achieve any particular result from creator content.

You must not promise or guarantee:

1. income;

2. profit;

3. investment returns;

4. business success;

5. employment;

6. qualifications;

7. grades;

8. health outcomes;

9. legal outcomes;

10. personal transformation;

11. any other specific result.

Any testimonials, case studies or examples must be truthful, not misleading, and clearly presented as individual examples rather than guaranteed outcomes.

16. Finance, Business and Investment Content

Creators may share general educational content about business, budgeting, money management, entrepreneurship, finance or investing only where that content is lawful, fair, balanced, clear and not misleading.

You must not use Fandations to provide regulated financial advice, investment recommendations, financial promotions, trading signals, crypto promotions, credit offers, debt advice, insurance advice, pension advice, tax advice or legal advice unless you are legally authorised to do so and have received written approval from Fandations.

You must not:

1. tell users to buy, sell or hold a specific investment;

2. provide personalised investment advice;

3. promote “guaranteed” returns;

4. promote get-rich-quick schemes;

5. operate unauthorised signal groups;

6. promote unauthorised copy trading;

7. make misleading claims about trading, crypto, forex, stocks or investments;

8. target vulnerable users with high-risk financial content;

9. hide conflicts of interest, sponsorships or affiliate commissions;

10. pressure users with fear, urgency or unrealistic claims.

The FCA has stated that financial promotion rules apply across social media channels, and it continues to take action against illegal “finfluencer” promotions. (FCA)

Fandations may remove finance-related content, restrict creator accounts, require additional disclaimers, request evidence of authorisation, or suspend payouts where we believe financial content may breach law, regulation or platform rules.

17. Health, Fitness and Wellbeing Content

Creators must not use Fandations to provide medical diagnosis, treatment, emergency advice, or regulated healthcare services unless legally authorised and approved by Fandations.

Health, fitness, nutrition, mental wellbeing or lifestyle content must be clearly educational and must not be misleading or unsafe.

Creators must not:

1. claim to cure, treat or diagnose medical conditions without authorisation;

2. encourage users to ignore professional medical advice;

3. promote dangerous diets, supplements or practices;

4. make unrealistic body, health or wellbeing claims;

5. exploit vulnerable users;

6. present personal opinion as medical fact.

Fandations may require disclaimers, remove content or restrict accounts where health-related content creates legal, safety or consumer risk.

18. Professional Advice

Unless you are properly qualified, authorised and approved by Fandations, you must not provide regulated or professional advice through Fandations, including:

1. financial advice;

2. investment advice;

3. tax advice;

4. legal advice;

5. medical advice;

6. psychological therapy;

7. debt advice;

8. insurance advice;

9. pension advice;

10. immigration advice.

Where you provide professional or specialist content, you are responsible for ensuring that you are legally permitted to do so.

19. Pricing, Subscriptions and Paid Content

Fandations may allow creators to offer:

1. free content;

2. paid posts;

3. paid downloads;

4. paid communities;

5. subscriptions;

6. one-off unlocks;

7. tips or support payments;

8. livestream access;

9. messaging access;

10. other paid creator features.

Available monetisation features may change over time.

You are responsible for ensuring that your pricing, descriptions, benefits and offers are accurate and not misleading.

You must clearly describe what users will receive before they purchase, subscribe or unlock content.

You must not materially change a paid offer after users have paid in a way that is unfair or misleading.

20. Platform Fees

Fandations may deduct platform fees, payment processor fees, currency conversion charges, taxes, refunds, chargebacks, payout fees, administrative charges or other applicable deductions from creator earnings.

The applicable fee structure will be made available through the platform, creator dashboard, payment pages or relevant policy.

Fees may vary depending on:

1. creator type;

2. payment method;

3. country;

4. currency;

5. product type;

6. promotion;

7. subscription;

8. payment processor charges;

9. tax or legal requirements.

We may update fees from time to time. Where required, we will provide notice of material fee changes.

21. Payments and Payouts

Creator earnings are subject to Fandations’ payment and payout rules.

Payouts may depend on:

1. successful payment collection;

2. completion of identity checks;

3. completion of tax checks;

4. payment processor approval;

5. minimum payout thresholds;

6. fraud checks;

7. chargeback risk;

8. refund risk;

9. sanctions checks;

10. compliance reviews;

11. account standing;

12. applicable law.

We may delay, withhold, offset, reverse or refuse payouts where we reasonably believe funds are connected to:

1. fraud;

2. chargebacks;

3. refunds;

4. payment disputes;

5. stolen payment methods;

6. illegal content;

7. prohibited content;

8. policy breaches;

9. tax obligations;

10. sanctions concerns;

11. identity verification issues;

12. suspicious activity;

13. money laundering risk;

14. platform misuse;

15. legal or regulatory obligations.

You are not entitled to receive payouts from transactions that are refunded, reversed, charged back, fraudulent, unlawful, disputed or otherwise invalid.

22. Refunds and Chargebacks

Fandations may issue refunds in accordance with its Refund Policy, applicable law, payment processor rules, consumer protection obligations, or platform discretion.

Creator earnings may be reduced, reversed, withheld or offset to account for:

1. refunds;

2. chargebacks;

3. disputes;

4. duplicate payments;

5. unauthorised payments;

6. fraud claims;

7. technical errors;

8. policy breaches;

9. legal obligations.

If your account has a negative balance, we may offset future earnings, restrict payouts, request repayment, suspend your account, or take other reasonable action.

23. Taxes and Reporting

You are responsible for determining, reporting and paying all taxes, duties, charges, levies, national insurance contributions and other amounts due in connection with your creator earnings.

Fandations does not provide tax advice.

We may be required to collect, verify, retain and report certain information about creators, sellers, transactions and earnings to HMRC or other tax authorities.

This may include:

1. legal name;

2. address;

3. date of birth;

4. tax identification number;

5. VAT information;

6. bank or payout details;

7. transaction information;

8. earnings information;

9. country of residence;

10. account information.

HMRC’s digital platform reporting rules require certain UK digital platform operators to report seller income information, and GOV.UK guidance states that reports for a reporting period may be due by 31 January after the relevant year. (GOV.UK)

You agree to provide accurate tax information when requested. Failure to do so may result in payout delays, payout withholding, account restrictions or termination.

24. Off-Platform Payments

You must not use Fandations to avoid platform fees or payment systems.

You must not encourage users to pay you outside Fandations for content, access, subscriptions, unlocks, services or benefits that are offered, discovered or promoted through Fandations, unless we have given written permission.

Examples of prohibited conduct include:

1. asking users to pay by bank transfer instead of using Fandations checkout;

2. directing users to external paid communities to avoid Fandations fees;

3. hiding payment links in images, videos, messages or profiles;

4. offering discounts only if users pay outside Fandations;

5. using coded language to bypass payment rules.

We may restrict features, remove content, suspend payouts or terminate accounts for payment circumvention.

25. External Links

Creators may be allowed to share external links where permitted by Fandations.

External links must not be used to:

1. bypass Fandations payments;

2. distribute prohibited content;

3. send users to adult content;

4. promote scams or fraud;

5. host malware or phishing pages;

6. collect personal data unlawfully;

7. mislead users;

8. evade moderation;

9. provide regulated services unlawfully;

10. breach Fandations policies.

We may block, remove, scan, review, restrict or disable external links at any time.

26. Advertising, Sponsorships and Affiliate Links

Creators must clearly disclose paid promotions, sponsorships, affiliate links, referral arrangements, gifted products, commissions, incentives or other commercial relationships.

You must not make misleading advertising claims.

You are responsible for ensuring that your advertising and promotional content complies with applicable consumer protection, advertising, financial promotion and platform rules.

Fandations may remove sponsored or affiliate content that we believe is misleading, unlawful, harmful, undisclosed or unsuitable.

27. Copyright and Intellectual Property Complaints

You must only upload content that you own or are authorised to use.

Fandations may remove content in response to copyright, trademark, intellectual property, privacy, publicity, confidentiality or other rights complaints.

We may terminate or restrict accounts of repeat infringers.

If you believe your content has been copied or used without permission, you may contact:

You should include enough information for us to identify the content, understand the complaint, and contact you.

28. User Interaction and Messaging

If Fandations provides messaging, comments, livestream chat, communities, replies or other interaction tools, you must use them responsibly.

You must not use user interaction features to:

1. harass users;

2. pressure users into purchases;

3. send spam;

4. send sexual content;

5. request sexual content;

6. request personal financial information;

7. request passwords or login credentials;

8. conduct scams;

9. manipulate users;

10. send harmful links;

11. move users off-platform to evade rules.

We may review, restrict or moderate messages and interactions where permitted by law and our Privacy Policy, especially for safety, security, fraud prevention, moderation, support and legal compliance.

29. Reports, Complaints and Cooperation

You agree to cooperate with Fandations in connection with:

1. user reports;

2. copyright complaints;

3. safety complaints;

4. payment disputes;

5. refund requests;

6. chargebacks;

7. tax checks;

8. verification checks;

9. moderation reviews;

10. legal or regulatory requests.

You must respond truthfully and promptly to reasonable requests for information.

Failure to cooperate may result in content removal, account restrictions, payout holds, suspension or termination.

30. Records and Audit Logs

Fandations may keep records relating to creator activity, including:

1. account information;

2. verification status;

3. content uploads;

4. content changes;

5. reports;

6. complaints;

7. moderation decisions;

8. warnings;

9. user transactions;

10. payouts;

11. refunds;

12. chargebacks;

13. tax reporting;

14. support communications;

15. security logs;

16. compliance reviews.

These records may be retained for legal, tax, accounting, fraud prevention, safety, audit, dispute resolution and compliance purposes.

31. Data Protection

Fandations will process creator personal data in accordance with its Privacy Policy.

Creator data may be processed for purposes including:

1. account creation;

2. identity verification;

3. age verification;

4. fraud prevention;

5. payout processing;

6. tax reporting;

7. customer support;

8. moderation;

9. safety;

10. legal compliance;

11. platform analytics;

12. security;

13. dispute handling.

Where we use third-party providers for payments, hosting, analytics, verification, tax reporting or support, creator data may be shared with those providers where necessary.

32. Suspension and Termination

You may stop using Fandations or close your creator account, subject to any outstanding obligations, pending payments, tax requirements, disputes, investigations, user access rights or legal obligations.

Fandations may suspend, restrict or terminate your creator account at any time if we believe:

1. you breached this Agreement;

2. you breached platform policies;

3. you provided false information;

4. you failed verification;

5. you uploaded prohibited content;

6. your content may be illegal;

7. you infringed third-party rights;

8. you misled users;

9. you engaged in fraud or platform abuse;

10. you caused chargeback or payment risk;

11. you created safety or reputational risk;

12. you attempted to bypass platform payments;

13. you failed to provide tax or payout information;

14. we are required to do so by law, regulator, payment processor, court order or authority;

15. continuing to provide services to you would create risk for Fandations or users.

33. Effect of Termination

After termination:

1. your creator profile may be removed or restricted;

2. your content may be removed or disabled;

3. your access to creator tools may end;

4. unpaid earnings may be paid, withheld, offset or forfeited according to this Agreement and applicable law;

5. users who previously purchased, subscribed to, downloaded or unlocked content may retain access where permitted;

6. Fandations may retain records for legal, tax, accounting, safety, fraud, audit, dispute and compliance purposes;

7. licences granted to Fandations may continue as necessary for platform operation, user access, backups, disputes, legal obligations and compliance.

Termination does not affect rights or obligations that arose before termination.

34. Payout Holds After Termination

We may continue to hold funds after suspension or termination where reasonably necessary to cover:

1. refunds;

2. chargebacks;

3. disputes;

4. fraud investigation;

5. tax obligations;

6. payment processor requirements;

7. user complaints;

8. legal claims;

9. sanctions screening;

10. regulatory obligations;

11. platform policy enforcement.

Where possible and lawful, we will release eligible funds after relevant risks have been resolved.

35. Disclaimers

Fandations provides the platform on an “as is” and “as available” basis.

We do not guarantee that:

1. the platform will always be available;

2. the platform will be error-free;

3. your content will receive views, followers, subscribers or sales;

4. users will purchase your content;

5. you will earn any particular amount;

6. content will never be copied, downloaded, screen-recorded or misused by users;

7. moderation decisions will always be perfect;

8. third-party providers will always operate without interruption.

You use Fandations at your own risk.

36. Limitation of Liability

Nothing in this Agreement limits or excludes liability where it would be unlawful to do so.

To the maximum extent permitted by law, Fandations will not be liable for:

1. loss of profits;

2. loss of revenue;

3. loss of business;

4. loss of goodwill;

5. loss of data;

6. loss of opportunity;

7. indirect or consequential loss;

8. user misuse of your content;

9. payment processor delays;

10. third-party service failures;

11. unauthorised copying or sharing by users;

12. account restrictions resulting from your breach of this Agreement.

Fandations’ total liability to you in connection with this Agreement will be limited to the amount of platform fees retained by Fandations from your creator earnings during the six months before the event giving rise to the claim, unless a different limit is required by law.

37. Indemnity

You agree to indemnify and hold harmless Fandations, its directors, officers, employees, contractors, agents, service providers and affiliates from and against any claims, losses, liabilities, damages, costs, expenses, legal fees or demands arising out of or connected with:

1. your content;

2. your creator profile;

3. your services;

4. your communications with users;

5. your breach of this Agreement;

6. your breach of platform policies;

7. your breach of law;

8. your infringement of third-party rights;

9. your tax obligations;

10. your misleading claims;

11. your unauthorised financial, legal, health or professional advice;

12. your fraud, misconduct or platform abuse;

13. your failure to obtain consent, licences or permissions.

38. Changes to This Agreement

We may update this Creator Agreement from time to time.

Where changes are material, we may notify you by email, platform notice, dashboard notice or other reasonable method.

Your continued use of Fandations as a creator after changes take effect means you accept the updated Agreement.

If you do not agree to the updated Agreement, you must stop using Fandations as a creator and may close your creator account, subject to outstanding obligations.

39. Assignment

You may not assign, transfer or delegate this Agreement or your creator account without our prior written consent.

Fandations may assign or transfer this Agreement as part of a merger, acquisition, restructuring, sale of assets, change of control, or transfer of business operations.

40. Severability

If any part of this Agreement is found to be invalid, unlawful or unenforceable, the remaining parts will continue in full force and effect.

41. No Waiver

If Fandations does not enforce a right or provision of this Agreement, that does not mean we waive that right or provision.

42. Governing Law and Jurisdiction

This Agreement is governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising out of or relating to this Agreement, except where applicable consumer or mandatory law gives you rights to bring claims elsewhere.

Creator Confirmation

By applying to become a creator or continuing to use Fandations as a creator, you confirm that:

1. you are at least 18 years old;

2. you have read and understood this Creator Agreement;

3. you agree to comply with all Fandations policies;

4. you will only upload content you own or are authorised to use;

5. you will not upload adult sexual content or prohibited content;

6. you will not provide regulated financial, legal, tax, medical or professional advice unless legally authorised and approved by Fandations;

7. you are responsible for your content, conduct, tax affairs and legal compliance;

8. you understand that Fandations may review, remove, restrict, suspend or terminate creator access where required for safety, legal, payment, tax, fraud or policy reasons.
